
Terms of Service
1. Pricing and Payment Terms

All invoices should be paid within 14 business days of being issued or at end of the month, or agreed monthly payment schedule.

Property Lens NZ reserves the right to require payment from clients ahead of the delivery of media, while a preview of the work will be provided.

Bookings outside of our core service areas (Northland and Auckland) may require a 50% deposit at time of booking.

Property Lens NZ’s prices are displayed on our booking forms and in a pricing list on our website. The prices as displayed on the website at the time of booking will be considered final and binding. Any changes in prices will be communicated to existing clients in writing.
2. Cancellation and Rescheduling

Property Lens NZ will allow rescheduling for reasons such as property not ready or vendor request up to 4 hours before a scheduled booking. Cancellation within 4 hours of a scheduled shoot will incur a 25% charge.

In case of rain or bad weather the shoot may be rescheduled to a new time without charge.

Missed shoots, where a photographer attends a property but the shoot cannot be started or completed due to the fault of the agent or vendor, will incur a 50% fee + normal travel fee. Photographer will wait on site for minimum of 30 minutes.

Occasionally, Property Lens NZ may need to cancel or reschedule a shoot for reasons including photographer illness or other circumstances outside of our control. In this case, we will reschedule the shoot at the earliest possible time. Property Lens NZ accepts no liability for photographer-initiated cancellations or rescheduling.
3. Rights and Usage

Property Lens NZ grants the client a one-time, non-exclusive, non-transferable licence for full use of the delivered photographs, videos, and other media content for the purpose of marketing or selling or renting the property specified in the booking.

The Client is not permitted to sublicense media content to any third party for their use, or use the photographs for any property other than the property specified in the booking, without seeking written permission from Property Lens NZ.

Property Lens NZ retains full copyright & ownership of all media we produce.

Property Lens NZ reserves the right to use the photographs for portfolio purposes, including but not limited to displaying on Property Lens NZ’s website, in promotional materials and social media, unless otherwise agreed in writing.
4. Delivery of Images

Property Lens NZ strives to deliver edited photographs within one (1) working day. Twighlight shoots or photo shoots that finish after 5pm will be delivered within 36 hours (morning of the following day.

Edited videos will usually be delivered within three (3) working days.

If clients wish to make custom selections of photos or require additional edits this will extend the delivery timeline. For media with custom requests or additional complexity, delivery make take longer – in this case, we will notify customers at the time of booking.

If Property Lens NZ cannot deliver within the usual timeframe, this will be communicated to the client. Late delivery will not affect payment obligations.

Property Lens NZ accepts no liability arising from late delivery.
5. Editing and Retouching

Standard editing of photographs includes balancing of colour, lighting, and visual appearance. Blue skies are usually added as standard to all photographs.

Retouching of photographs, including the removal of unwanted items, digital staging, or other effects such as smoothing of bed sheets, will usually incur an additional fee per photo that will be agreed upon before work begins. In cases where a photographer has directly caused a defect or has failed to utilize good judgement on site, we will remedy this without charge.

Removal of homeowner personal effects such as photographs can usually be done free of charge; in this case, a blur effect may be used.

Clients may request one round of photo editing free of charge, and two rounds of video editing free of charge. Beyond that, charges for additional editing requests will apply.

Refunds will not be given due to clients not liking photos.
6. Client Responsibilities

The client is responsible for preparing the property before shooting and communicating requirements for a successful shoot to the vendor ahead of the scheduled booking.

In the case that a property is not ready to be photographed when the photographer arrives on site, the shoot may be rescheduled to a later time, but the client will be charged 50% of the total booking fee and the normal travel fee.

If a photographer proceeds with a shoot of a home that is not 'shoot-ready', this may affect the quality of the final deliverables.

The client is responsible for ensuring that the photographer has access to the property. Missed shoots, where a photographer attends a property but the shoot cannot be started or completed due to the fault of the agent or vendor will incur a 50% fee + normal travel fee. Photographer will wait on site for minimum of 30 minutes. Please note that a late start may limit the amount of time available for the photographer to spend at the shoot.

The client is responsible for ensuring a safe working environment for our photographers, including but not limited to removing all site hazards.
7. Liability and Indemnification

Property Lens NZ is not liable for any damages or losses that occur during or as a result of the photo shoot, except in cases of gross negligence or willful misconduct.

The Client agrees to indemnify and hold Property Lens NZ harmless from any claims, damages, or expenses arising from the Client’s use of the photographs or the services provided.
8. Modifications and Amendments

Property Lens NZ reserves the right to modify or amend these Terms of Service at any time. Continued use of Property Lens NZ’s services after any modifications constitutes acceptance of the updated terms.
9. Acceptance of Terms

A client may book our services via website booking form, email, SMS, or verbal agreement. In all cases, by booking and using the services, the Client agrees to the terms of service as outlined above.
